  79. Definitions.
  80. ~~~~~~~~~~~
  81. 'Software' or 'Program' means the ChaoSoft software product
  82. File Manager Guard (FM Guard), including both the software and the
  83. associated documentation and other materials;
  84.  
  85. 'Unregistered Copy' means a copy of the Program you obtained from
  86. us or other source for evaluation purposes and which is described
  87. as "Unregistered copy" in the 'About' screen. An Unregistered Copy
  88. may be converted to registered one by supplying a name of a
  89. registered user or institution and a correct Registration Code,
  90. which may be obtained from ChaoSoft or its authorized dealer(s).
  91.  
  92. 'Registered Copy' means a copy of the Program registered with
  93. ChaoSoft or with its authorized dealer, and which is described as
  94. "Registered to: <user name>" in the 'About' screen. A Registered
  95. Copy may be unregistered by copying it to another disk or
  96. computer, or by removing the registration information from an
  97. initialization file.
  98.  
  99. 'Registration Package' means all the materials you are obtaining
  100. from us after sending us your registration fee. In particular,
  101. Registration Package contains your personal Registration Code,
  102. allowing you to remove the registration reminder message and put
  103. your name in the 'About' screen.

  105. 'we' or 'us' means ChaoSoft, a company produced this software

  109. 'you' means the end user or distributor of the Software.

  126. The software is NOT a public domain or free program. It is owned
  127. by ChaoSoft and is protected by United States copyright laws and
  128. international treaty provisions. Therefore, you must treat the
  129. Software like any other copyrighted material except that a limited
  130. right to make copies of the Software, subject to conditions of
  131. this license agreement, is granted to you. You may not copy any
  132. written or printed materials from your Registration Package and
  133. you may not rent or lease a Registered Copy of the Software.

  135. TRIAL USE LICENSE

  137. ChaoSoft grants to you a limited license to use an Unregistered
  138. Copy of this software for evaluation purposes for a period not to
  139. exceed 21 days.

  141. This period may be not a contiguous sequence of days. However, you
  142. should count a day as an evaluation day if you used the Program
  143. during that day at least once. The purpose of this evaluation
  144. period is to allow you to determine whether the program meets your
  145. needs before purchasing it.

  147. Once the evaluation period has ended, you MUST either purchase a
  148. license for continued use of the program, or stop using it.  Use of
  149. an Unregistered Copy beyond the end of the evaluation period without

  152. If you have sent out your registration fee, you may continue to
  153. use your Unregistered Copy beyond the end of the evaluation period

  156. Registering the Program.

  159. correct amount of registration fee to our authorized dealer.  You
  160. may use order form(s) supplied with the documentation to the
  161. Software.  After getting your Registration Package, containing the

  163. your Unregistered Copy of the Software into Registered one.

  165. You agree to keep the Registration Code for your own use only and
  166. not to share it with anybody else.

  168. REGISTERED COPY USE LICENSE

  170. ChaoSoft grants to you the right to use a Registered Copy of the
  171. software, if you registered (purchased a license for continued use)
  172. with us or our authorized dealer and obtained your Registration
  173. Code.

  175. You may install a Registered copy of the software on more than one
  176. computer (for example, desktop system and portable notebook),
  177. provided that you are the only user of those computers and there
  178. is no possibility to use the Registered Copy by anybody else.

  180. You may not network a Registered Copy or otherwise use it on more
  181. than one computer or computer terminal at the same time unless you
  182. have purchased a site license.
  183.  
  184. If the Registered Copy you are using is registered to anybody
  185. else, you MUST either unregister it by removing the registration
  186. information, or stop using it. Use of a Registered Copy,
  187. registered to anybody else except you (or, for site license
  188. arrangements, to your organization), is in violation of federal
  189. copyright laws.

  191. Multi-User and Network Use.

  193. If you registered the Software for use by multiple users,  you
  194. agree not to use the Program on more computers than the number
  195. specified in your site license. You may install the Program on
  196. computers attached to a network, or remove it from one computer
  197. and install it on a different one, provided there is NO
  198. POSSIBILITY that your copy will be installed or used on more
  199. computers than it is licensed for.  If you have a network, you
  200. don't need to include every computer attached to the network in
  201. your license, but you must include every computer on which the
  202. Program is installed or used, regardless of whether the user of
  203. the computer happens to know that the Program is in use on their
  204. system.  If you have single computers which allow multiple users
  205. to use the Program simultaneously, you must count each keyboard or
  206. terminal separately when determining how many computers are using
  207. the Program.

  209. LIMITED DISTRIBUTION LICENSE

  211. You may make as many copies of the Program as you wish, give it to

  263. LIMITED WARRANTY

  265. The following limited warranty applies to Registered Copies of the
  266. Program. This warranty does NOT apply to Unregistered Copies of
  267. the Program.

  269. Satisfaction Guarantee.  If you are dissatisfied with any product
  270. you buy from us under this Agreement for any reason, you may
  271. return it at any time up to 30 days after purchase and we will
  272. give you a refund. Refunds will be based on the price you paid,
  273. with shipping costs excluded.  You must contact us before
  274. returning any product for a refund. This satisfaction guarantee
  275. does not apply to multi-system licenses for more than 10
  276. computers, or to purchases of more than 10 individual copies at a
  277. time.

  279. Physical Defects.  We pledge that the disks, if any, and any
  280. printed material we send you will arrive free of physical defects
  281. which interfere with normal use. If you find such a defect and
  282. report it to us within 30 days after you get your Registration
  283. Package, we agree to replace the defective item(s) at no charge to
  284. you as long as the defect was not caused by misuse or abuse.

  286. Bugs and Program Errors.  We don't promise that the Software will
  287. be free of bugs or program errors, and you agree that bugs or
  288. program errors will not be considered as "physical defects" in the
  289. program. We agree that if you report a program error or bug to us,
  290. we will use our best efforts to correct it.

  337. Maine. The parties hereby consent to in personal jurisdiction of
  338. said courts.
